COMPLIANCE WITH LOCAL LAW 126

The Department of Buildings (DOB) recently released an update regarding Periodic Parking Structure Inspection as part of Local Law 126. This regulation requires all parking structures located in B- and C- Inspection Windows to have a one-time initial observation performed by or under the supervision of a Qualified Parking Structure Inspector (QPSI), with a report filed to the DOB by August 1, 2024. This is in addition to the existing inspection requirements your parking structure falls under.

  • Bronx, Queens, and Staten Island Community Districts: January 1, 2026 – December 31, 2027
  • Manhattan Community Districts 1, 2, 3, 4, 5, 6, 7: January 1, 2022 – December 31, 2023 – CLOSED, but still accepting reports.

3Exceptions

The following structures are exempt from the new inspection requirements:

  • Autobody and automotive repair shops, automotive showrooms, and automotive service stations
  • Garages with a capacity of fewer than three cars
  • Unenclosed, standalone outdoor parking lots
  • Private garages serving single-family and two-family homes

4Classifications

The QPSI will submit their report to the DOB with one of these classifications: SAFE, UNSAFE, Safe with Repair and/or Engineering Monitoring (SREM).

When a garage is classified as Safe with Repair and/or Engineering Monitoring, the following actions are required:

  • Outline the proposed monitoring program
  • Identify the engineer conducting the monitoring
  • Conduct a stability analysis demonstrating the structure is stable under expected loads

When a garage is classified as UNSAFE, the following actions are required:

  • Ensure public safety
  • Notify the DOB
  • Conduct necessary repairs

5Fees and Penalties

Unsafe conditions must be addressed within 90 days of filing a report with an Unsafe status. An amended report must be submitted within two weeks of completing the repairs. If repairs are not completed and an amended report is not filed within this period, extension requests must be submitted to the DOB and are subject to review and approval.

6DOB Fees

  • Initial Report: $305.00
  • Amended/Subsequent Report: $85.00
  • Extension Request: $65.00

      The following penalties apply after the filing deadline:

  • Late Filing (initial report): $1,000 per month
  • Failure to File (initial report): $5,000 per year
  • Failure to Correct Unsafe Conditions: $1,000 per month
  • Failure to Correct SREM Conditions: $2,000 (one-time)
